California Motorcycle Law Issues That Affect Your Case

  • Lane splitting is legal under Vehicle Code section 21658.1. Insurers will still argue you were moving unsafely. The facts, traffic conditions, and speed decide it.
  • Comparative negligence: you can recover even if you were partly at fault. Your award is reduced by your share, not erased.
  • Helmet use may become part of the damages dispute for head injuries, but it does not cancel a claim against a negligent driver.
  • Uninsured and underinsured motorist coverage on your own policy is often the most important coverage in a hit-and-run or a low-limits case.
  • Two years to file a personal injury lawsuit under Code of Civil Procedure section 335.1.
  • Gear and data: helmet damage, jacket abrasion, dashcam footage, and scene photos prove the force and mechanics of the collision.

Six-month government deadline: if a road defect, missing signage, or a government vehicle contributed to the crash, a written government claim must be filed within six months. Miss it and that part of your case is gone.

Is lane splitting legal in California?

Yes. California Vehicle Code section 21658.1 recognizes lane splitting. That does not stop insurance companies from arguing that a rider was splitting lanes unsafely, so the facts, traffic conditions, speed, and scene evidence still matter.

What if the police report says I was partly at fault?

Your case is not automatically over. Police reports are important, but they are not the final legal decision. California uses comparative negligence, which means you may still recover compensation even if fault is disputed.

How much is a motorcycle accident case worth?

Case value depends on liability, injuries, medical care, lost income, future treatment, pain and suffering, insurance limits, and long-term impact. Serious motorcycle injuries often require a deeper damages analysis than a quick insurance offer reflects.

What if the other driver has no insurance?
