Pedestrian Dies Weeks After Being Struck on South King Road in San Jose

A man who was struck by a car while crossing South King Road in San Jose last month has died from his injuries, the San Jose Police Department said.

According to police, the collision happened at about 7:48 p.m. on September 13 near South King Road and Biscayne Way. A 2014 Chevrolet SS sedan traveling northbound on South King Road struck an adult man who was crossing eastbound outside a marked crosswalk.

The man was taken to a hospital with life-threatening injuries and was later stabilized. On October 5, the Santa Clara County Office of the Medical Examiner notified detectives that he had died on October 2. The driver remained at the scene, called 911, and cooperated with investigators. Police said the preliminary investigation does not show drugs or alcohol as a factor.

The death is San Jose’s 39th fatal collision and 39th traffic death of 2026, according to police. The medical examiner will release the man’s identity.

When a Pedestrian Dies After a Delayed Period

Some pedestrian injuries lead to death days or weeks after a collision. When that happens, the investigation and any legal questions shift from an injury case to a possible wrongful-death matter, and medical records from the full course of treatment become an important part of the record.

Investigators typically examine lighting, visibility, vehicle speed, the pedestrian’s path, roadway design, and any available video. Crossing outside a crosswalk does not by itself decide who is legally responsible under California law, and no conclusion about fault should be drawn from the preliminary information released so far.

Legal Options for Families

California generally allows two years to file a wrongful-death claim, though some cases involve shorter deadlines. Families dealing with a delayed death may also have questions about medical bills that built up during treatment.
