What Police-Backed Reporting Says Happened

San Bruno police responded just before 1 a.m. on August 30 to a single-vehicle crash near El Camino Real and the westbound Interstate 380 off-ramp. The car had struck a light pole.

The 29-year-old driver and his 22-year-old passenger, both San Francisco residents, suffered major injuries. The passenger later died.

Driver Arrested on Suspicion of DUI and Manslaughter

Police alleged that the driver had been operating the vehicle under the influence of alcohol or drugs. He was booked on suspicion of gross vehicular manslaughter, DUI causing injury or death, and possession of a controlled substance.

Those are allegations. A criminal charge or arrest does not by itself establish civil liability, and the driver is presumed innocent unless proven guilty in court.

Potential Civil Claims for a Passenger's Family

Passengers generally are not responsible for how a vehicle is driven. A wrongful death investigation may examine impairment, speed, vehicle control, the crash sequence, insurance coverage, and whether any other condition contributed.
