Neighbor Kills Pastor in Front of Children: Widow Files Wrongful Death Lawsuit

On December 29, 2023, Pastor Nick Davi โ€” a 46-year-old father and community leader โ€” was shot and killed in front of his own home in North Las Vegas by his next-door neighbor, Joe Junio. His two children, ages 12 and 15, were sitting in the family’s vehicle when it happened and recorded the shooting on their phones. His wife Sarah was also shot and survived. The killing stemmed from a months-long homeowners association dispute. Incident Location

What Happened

Nick Davi was a 46-year-old pastor at Grace Point Church in the Las Vegas area and a well-known presence in his North Las Vegas community. He and his wife Sarah had two children: Olivia, 15, and Christian, 12. Their neighbor, Joe Junio, 36, lived next door in the same gated condominium development known as the Court at Aliante.

In the weeks leading up to December 29, 2023, the Davi family had filed complaints with their homeowners association against Junio over violations involving chickens and dogs kept on her property. According to the lawsuit filed on Sarah Davi’s behalf, those HOA complaints set off a pattern of escalating, threatening behavior by Junio. She allegedly threw rocks into the Davi family’s yard, dumped dog feces on their property, and at one point flooded their home. Most chillingly, court documents allege Junio confronted the family, ran her finger across her throat in a cutting motion, and told them they were “next.” The Davi family called police on at least two occasions and filed for a restraining order.

On the morning of December 29, 2023, Nick Davi was outside his home when Junio allegedly stepped out of her vehicle and opened fire. Nick was struck and killed. Sarah Davi was also shot and suffered serious injuries but survived. Their two children, who were sitting inside the family car, witnessed the entire event and recorded it on their cellphones. That video footage later became central to both the criminal prosecution and the civil lawsuit.

Investigators also learned that Junio did not have a license or permit to carry a firearm and had borrowed the weapon from another person. Authorities indicated they intended to pursue civil and potentially criminal liability against that individual as well. Junio was taken into custody and held at the Clark County Detention Center on a $300,000 bond. She pleaded not guilty. A preliminary hearing was initially scheduled for March 4, 2024, and prosecutors later announced they would not seek the death penalty.

Nick Davi was remembered as a devoted husband, father, pastor, and community member. A GoFundMe campaign raised over $90,000 for his family in the days following his death. He had ties to Riverhead, New York, where he graduated from Riverhead High School before building his life and ministry in Nevada.

The Wrongful Death Lawsuit

On January 19, 2024, Sarah Davi โ€” still recovering from her own gunshot injuries โ€” filed a wrongful death lawsuit. The suit named multiple defendants, not just the alleged shooter. Joe Junio was named directly for the shooting itself. But the lawsuit also named the Court at Aliante homeowners association and FirstService Nevada, the professional property management company that administered the HOA.

The lawsuit alleged that the HOA and its management company knew, or should have known, that Junio’s conduct posed a serious and escalating threat to the Davi family. The complaint argued that despite documented complaints, reports to police, and a restraining order request โ€” all of which put the community association on notice โ€” the HOA failed to take adequate action to protect the family from a neighbor who had made credible threats of violence.

This theory of liability โ€” holding an HOA or property management company responsible for failing to protect residents from foreseeable third-party harm โ€” is a recognized legal theory in both California and Nevada. When an organization with authority over a shared community has actual or constructive knowledge that one resident poses a danger to another, and does nothing meaningful to intervene, civil liability can follow.

The lawsuit sought compensation for wrongful death, including loss of financial support, loss of companionship and consortium, grief and sorrow, and punitive damages. Sarah Davi also brought personal injury claims for her own gunshot wounds and the severe emotional distress she suffered. Attorneys for the family indicated they also planned to pursue civil claims against the individual who supplied Junio with the firearm she used โ€” a person without a carry license โ€” once that person was identified.

By filing this civil lawsuit, Sarah Davi was doing something that the criminal justice system cannot do on its own: seeking accountability and financial relief through a parallel legal process, on behalf of herself and her children, for everything they lost on December 29, 2023.

Criminal vs. Civil Cases โ€” What Families Need to Know

One of the most important and misunderstood aspects of cases like this is the relationship between a criminal prosecution and a civil wrongful death lawsuit. Many families believe they have to wait for the criminal case to conclude โ€” or even for a criminal conviction โ€” before pursuing civil remedies. That is not the law.

Criminal charges are brought by the government โ€” a prosecutor acts on behalf of the state, not the victim’s family. The goal is punishment: incarceration, fines, or in some states, the death penalty. The standard of proof in a criminal case is “beyond a reasonable doubt,” the highest standard in the legal system.

A civil wrongful death lawsuit is brought by the family. The goal is financial accountability and compensation for the losses the family has suffered. The standard of proof in a civil case is the “preponderance of the evidence” โ€” meaning it is more likely than not that the defendant’s conduct caused the death. This is a substantially lower bar than the criminal standard, which is why civil cases can succeed even when criminal charges result in acquittal or reduced charges.

The most well-known example of this is the O.J. Simpson case. Simpson was acquitted in his 1995 criminal murder trial. But in 1997, a civil jury found him liable for the wrongful deaths of Nicole Brown Simpson and Ron Goldman and awarded the families $33.5 million in damages. The families’ attorneys pursued the civil case simultaneously with and after the criminal matter, using the lower civil standard to achieve accountability in court.

In the Nick Davi case, Sarah Davi did not wait for the criminal proceedings to play out. She filed her civil lawsuit less than a month after her husband’s death. The civil and criminal cases will proceed on their own tracks, governed by different rules, different standards, and different goals โ€” but both exist because of the same act of violence.

For California families who lose a loved one to intentional violence or negligence, the same framework applies. California law gives surviving spouses, children, and other close family members the right to bring wrongful death claims and pursue damages independently of whatever happens in any parallel criminal case. The statute of limitations in California is generally two years from the date of death, which means time-sensitive legal consultation matters โ€” even when a criminal case is still unfolding.

Legal Options for Families in Similar Situations

The Scale of Wrongful Death and Intentional Violence Claims

Lower Standard
Civil wrongful death cases use the “preponderance of evidence” standard โ€” more likely than not โ€” compared to “beyond a reasonable doubt” in criminal court. Civil accountability is achievable even when criminal charges fail.
American civil procedure
Multiple Defendants
Wrongful death lawsuits can name any party whose negligence or misconduct contributed to the death โ€” including HOAs, property managers, employers, and firearm suppliers โ€” not only the person who carried out the act.
California and Nevada civil liability law
2 Years
California’s statute of limitations for wrongful death claims is generally two years from the date of death. Acting promptly after a tragedy protects both the legal claim and the evidence needed to support it.
California Code of Civil Procedure ยง 335.1
Children as Witnesses
When minor children witness a parent’s death โ€” as Olivia and Christian Davi did โ€” courts recognize significant claims for emotional harm, trauma, and loss of parental guidance that extend beyond the primary wrongful death damages. These claims can substantially affect the total recovery available to the family.

Frequently Asked Questions

Can a family file a wrongful death lawsuit even if criminal charges are already pending?
Yes. A wrongful death civil lawsuit is completely separate from any criminal prosecution. The family does not need to wait for a criminal conviction โ€” and does not need one at all โ€” to pursue civil damages. The civil case uses a lower standard of proof (preponderance of the evidence) than the criminal case (beyond a reasonable doubt), which means civil liability can be established even when criminal charges are pending, reduced, or result in acquittal.
Who can be named as a defendant in a wrongful death lawsuit beyond the person who pulled the trigger?
In cases like the Nick Davi shooting, multiple parties may share legal liability. The shooter faces direct liability. A homeowners association or property management company may be liable if it knew about ongoing threats and failed to act. The person who provided the firearm to someone without a license or permit may also face civil liability. An experienced wrongful death attorney will investigate every potential defendant to maximize recovery for the family.
What damages can a surviving spouse recover in a wrongful death lawsuit?
Under California law โ€” which applies similar principles to many states including Nevada โ€” a surviving spouse may recover compensation for the loss of the deceased’s financial support, loss of companionship and consortium, grief and emotional distress, funeral and burial expenses, and in some cases punitive damages when the conduct was especially willful or malicious. When children witness a parent’s death, courts may also recognize claims for the severe emotional harm the children suffered.
How long does a family have to file a wrongful death lawsuit in California?
In California, the statute of limitations for a wrongful death claim is generally two years from the date of the death. Missing this deadline can permanently bar the claim, which is why families are strongly advised to consult with a wrongful death attorney as soon as possible after a tragedy โ€” even while criminal proceedings are still underway.
