Preguntas Frecuentes

Can a family file a wrongful death claim if the perpetrator is never caught?
Yes. A wrongful death lawsuit is a civil action, separate from any criminal case. Even if the shooter is never identified or apprehended, the family may still pursue claims against other potentially responsible parties — such as the employer, a property owner, or a security company — if their negligence contributed to the death.
Can an employer be held liable when a worker is killed by a third party?
Sometimes. Employers have a duty to provide a reasonably safe working environment. If a trucking company or delivery employer failed to implement adequate safety protocols, ignored known risks, or routed drivers through dangerous areas without warning, they may share liability for a driver's death. California workers' compensation laws also typically provide death benefits to dependents.
What evidence is critical in a truck accident wrongful death case?
Dash cam footage, GPS data from the truck, ELD (electronic logging device) records, witness statements, dispatch communications, and surveillance video from nearby businesses or highways. In incidents involving violence, ballistics evidence and law enforcement reports become central to identifying who caused the death.
Who else could be affected by a truck crash like this?
Bystanders and witnesses can suffer significant psychological trauma even without physical injuries. Owners of damaged vehicles or businesses can pursue property damage claims. In California, those who suffer emotional distress from witnessing such events may, in limited circumstances, have legal claims as well.
