He and his wife Sarah had two children: Olivia, 15, and Christian, 12. Their neighbor, Joe Junio, 36, lived next door in the same gated condominium development known as the Court at Aliante.<\/p>\n      <p>In the weeks leading up to December 29, 2023, the Davi family had filed complaints with their homeowners association against Junio over violations involving chickens and dogs kept on her property. According to the lawsuit filed on Sarah Davi&#8217;s behalf, those HOA complaints set off a pattern of escalating, threatening behavior by Junio. She allegedly threw rocks into the Davi family&#8217;s yard, dumped dog feces on their property, and at one point flooded their home. Most chillingly, court documents allege Junio confronted the family, ran her finger across her throat in a cutting motion, and told them they were &#8220;next.&#8221; The Davi family called police on at least two occasions and filed for a restraining order.<\/p>\n      <p>On the morning of December 29, 2023, Nick Davi was outside his home when Junio allegedly stepped out of her vehicle and opened fire. Nick was struck and killed. Sarah Davi was also shot and suffered serious injuries but survived. Their two children, who were sitting inside the family car, witnessed the entire event and recorded it on their cellphones. That video footage later became central to both the criminal prosecution and the civil lawsuit.<\/p>\n      <p>Investigators also learned that Junio did not have a license or permit to carry a firearm and had borrowed the weapon from another person. Authorities indicated they intended to pursue civil and potentially criminal liability against that individual as well. Junio was taken into custody and held at the Clark County Detention Center on a $300,000 bond. She pleaded not guilty. A preliminary hearing was initially scheduled for March 4, 2024, and prosecutors later announced they would not seek the death penalty.<\/p>\n      <p>Nick Davi was remembered as a devoted husband, father, pastor, and community member. A GoFundMe campaign raised over $90,000 for his family in the days following his death. He had ties to Riverhead, New York, where he graduated from Riverhead High School before building his life and ministry in Nevada.<\/p>\n\n      <h2>The Wrongful Death Lawsuit<\/h2>\n      <p>On January 19, 2024, Sarah Davi \u2014 still recovering from her own gunshot injuries \u2014 filed a wrongful death lawsuit. The suit named multiple defendants, not just the alleged shooter. Joe Junio was named directly for the shooting itself. But the lawsuit also named the Court at Aliante homeowners association and FirstService Nevada, the professional property management company that administered the HOA.<\/p>\n      <p>The lawsuit alleged that the HOA and its management company knew, or should have known, that Junio&#8217;s conduct posed a serious and escalating threat to the Davi family. The complaint argued that despite documented complaints, reports to police, and a restraining order request \u2014 all of which put the community association on notice \u2014 the HOA failed to take adequate action to protect the family from a neighbor who had made credible threats of violence.<\/p>\n      <p>This theory of liability \u2014 holding an HOA or property management company responsible for failing to protect residents from foreseeable third-party harm \u2014 is a recognized legal theory in both California and Nevada. When an organization with authority over a shared community has actual or constructive knowledge that one resident poses a danger to another, and does nothing meaningful to intervene, civil liability can follow.<\/p>\n      <p>The lawsuit sought compensation for wrongful death, including loss of financial support, loss of companionship and consortium, grief and sorrow, and punitive damages. Sarah Davi also brought personal injury claims for her own gunshot wounds and the severe emotional distress she suffered. Attorneys for the family indicated they also planned to pursue civil claims against the individual who supplied Junio with the firearm she used \u2014 a person without a carry license \u2014 once that person was identified.<\/p>\n      <p>By filing this civil lawsuit, Sarah Davi was doing something that the criminal justice system cannot do on its own: seeking accountability and financial relief through a parallel legal process, on behalf of herself and her children, for everything they lost on December 29, 2023.<\/p>\n\n      <h2>Criminal vs. Civil Cases \u2014 What Families Need to Know<\/h2>\n      <p>One of the most important and misunderstood aspects of cases like this is the relationship between a criminal prosecution and a civil wrongful death lawsuit. Many families believe they have to wait for the criminal case to conclude \u2014 or even for a criminal conviction \u2014 before pursuing civil remedies. That is not the law.<\/p>\n      <p>Criminal charges are brought by the government \u2014 a prosecutor acts on behalf of the state, not the victim&#8217;s family. The goal is punishment: incarceration, fines, or in some states, the death penalty. The standard of proof in a criminal case is &#8220;beyond a reasonable doubt,&#8221; the highest standard in the legal system.<\/p>\n      <p>A civil wrongful death lawsuit is brought by the family. The goal is financial accountability and compensation for the losses the family has suffered. The standard of proof in a civil case is the &#8220;preponderance of the evidence&#8221; \u2014 meaning it is more likely than not that the defendant&#8217;s conduct caused the death. This is a substantially lower bar than the criminal standard, which is why civil cases can succeed even when criminal charges result in acquittal or reduced charges.<\/p>\n      <p>The most well-known example of this is the O.J. Simpson case. Simpson was acquitted in his 1995 criminal murder trial. But in 1997, a civil jury found him liable for the wrongful deaths of Nicole Brown Simpson and Ron Goldman and awarded the families $33.5 million in damages. The families&#8217; attorneys pursued the civil case simultaneously with and after the criminal matter, using the lower civil standard to achieve accountability in court.<\/p>\n      <p>In the Nick Davi case, Sarah Davi did not wait for the criminal proceedings to play out. She filed her civil lawsuit less than a month after her husband&#8217;s death.
