Vehicle Code section 21658.1 authorizes CHP educational guidance, while the<br \/>\n    practical safety analysis remains focused on the rider, traffic, roadway, visibility, and available space:\n  <\/p>\n<ul>\n<li>Consider the total environment before splitting: lane width, the size of surrounding vehicles, weather,<br \/>\n      lighting, and road conditions.<\/li>\n<li>Danger rises as your speed and the speed difference between you and traffic increase. A large speed<br \/>\n      difference gives everyone less time to react.<\/li>\n<li>Choose the lane position with the fewest merging and turning conflicts.<\/li>\n<li>Use extra caution near freeway on-ramps and off-ramps, where traffic merges and shifts.<\/li>\n<li>Avoid lingering next to large vehicles such as trucks, buses, and motorhomes.<\/li>\n<li>Be visible. Stay out of blind spots, wear bright or reflective gear, and keep your headlight on.<\/li>\n<li>If you are new to lane splitting, be extra cautious and build up experience gradually.<\/li>\n<\/ul>\n<p>\n    These considerations are not a separate numeric speed law. After a crash, however, an insurer may use the<br \/>\n    surrounding conditions to argue that either the rider or driver acted unsafely. That is where fault comes in.\n  <\/p>\n<h2>Who Is at Fault in a Lane Splitting Accident?<\/h2>\n<p>\n    Fault in a lane splitting crash is decided the same way as any other California collision: by comparing each<br \/>\n    party&#8217;s negligence. Because California follows <strong>pure comparative negligence<\/strong>, fault is split by<br \/>\n    percentage, and a rider can recover damages even while bearing part of the blame. If a rider is found 25<br \/>\n    percent at fault and the driver 75 percent, the rider still recovers 75 percent of their damages.\n  <\/p>\n<p>\n    Legal lane splitting does not hand fault to the rider. Drivers still have duties: to check mirrors and blind<br \/>\n    spots, to signal before changing lanes, and not to block or &#8220;brake check&#8221; a splitting rider. A driver who<br \/>\n    drifts into a splitting motorcycle without looking, or who opens a door or swerves to prevent a rider from<br \/>\n    passing, can be found largely or entirely at fault. On the other side, a rider splitting at a high speed<br \/>\n    differential in tight conditions may pick up a share of fault. The facts, and the evidence, decide it.\n  <\/p>\n<h2>What Arguments and Myths Do Drivers and Insurers Use?<\/h2>\n<p>\n    After a lane splitting crash, expect some predictable claims from the other side. Knowing them ahead of time<br \/>\n    helps you protect your case.\n  <\/p>\n<ul>\n<li><strong>&#8220;Lane splitting is illegal.&#8221;<\/strong> It is not, and has not been since 2017. This myth still<br \/>\n      shows up in adjuster conversations and even in some drivers&#8217; statements.<\/li>\n<li><strong>&#8220;I never saw the motorcycle.&#8221;<\/strong> Not seeing a rider is not a defense. NHTSA reports that the<br \/>\n      majority of multi-vehicle motorcycle crashes happen precisely because the other driver failed to see the<br \/>\n      rider, which points to the driver&#8217;s inattention, not the rider&#8217;s fault.<\/li>\n<li><strong>&#8220;The rider came out of nowhere.&#8221;<\/strong> Usually shorthand for a driver who changed lanes without<br \/>\n      checking. Physical evidence and vehicle positioning often tell a different story.<\/li>\n<li><strong>&#8220;You were speeding between cars.&#8221;<\/strong> Sometimes valid, often exaggerated. Speed can be<br \/>\n      reconstructed from evidence rather than assumed.<\/li>\n<\/ul>\n<h2>What Should You Do If You Are Hit While Lane Splitting?<\/h2>\n<p>\n    What you do in the first hours can shape the whole claim. If you are able:\n  <\/p>\n<ol>\n<li>Call 911 and get medical attention. Some serious injuries, including brain injuries, do not feel serious<br \/>\n      at the scene.<\/li>\n<li>Report the crash and make sure a traffic collision report is created.<\/li>\n<li>Photograph everything: vehicle positions, your bike, the roadway, skid marks, and your gear.<\/li>\n<li>Get names and numbers of witnesses before they leave.<\/li>\n<li>Do not admit fault or guess at speeds.
