A driver can be acquitted in criminal court and still be held financially responsible in a civil wrongful death case.<\/p>\n<p>In California, wrongful death is governed by <strong>California Code of Civil Procedure \u00a7 377.60<\/strong>. The law specifies who has the right to bring the claim, what damages are available, and how those damages are divided.<\/p>\n<p>The purpose of a wrongful death case is not to punish \u2014 punitive damages in wrongful death are limited under California law. The purpose is to make the family financially whole, to the extent that any amount of money can do that, for the loss of the person they loved.<\/p>\n<h3>Who Can File a Wrongful Death Claim in California?<\/h3>\n<p>This is one of the most common questions families ask, and one of the most important to get right. Under <strong>CCP \u00a7 377.60<\/strong>, the people entitled to bring a wrongful death claim, in order of priority, are:<\/p>\n<ul>\n<li><strong>The surviving spouse<\/strong> of the person who died<\/li>\n<li><strong>The registered domestic partner<\/strong><\/li>\n<li><strong>The surviving children<\/strong><\/li>\n<li><strong>The grandchildren<\/strong> of any deceased child<\/li>\n<li><strong>Anyone else<\/strong> who would be entitled to inherit under California&#x27;s intestate succession laws if there is no surviving spouse, partner, or descendants<\/li>\n<\/ul>\n<p>In addition, the following people may have a claim <strong>if they were financially dependent<\/strong> on the person who died:<\/p>\n<ul>\n<li><strong>The decedent&#x27;s parents<\/strong><\/li>\n<li><strong>The decedent&#x27;s stepchildren<\/strong><\/li>\n<li><strong>A &quot;putative spouse&quot;<\/strong> (someone who in good faith believed they were legally married to the decedent) and that putative spouse&#x27;s children<\/li>\n<li><strong>Minors who lived in the decedent&#x27;s household for at least 180 days<\/strong> and who were dependent on the decedent for one-half or more of their support<\/li>\n<\/ul>\n<p>California treats the wrongful death claim as a single action \u2014 not a series of separate lawsuits. That means all eligible heirs generally have to be brought into one case, and the recovery is divided among them based on their respective losses. Part of our job is to keep the focus on the case while you grieve.<\/p>\n<h3>Wrongful Death vs. Survival Actions \u2014 Two Claims, Often Filed Together<\/h3>\n<p>People often use &quot;wrongful death&quot; as a catch-all term, but California law actually recognizes two separate types of claims that can arise from the same incident:<\/p>\n<p><strong>Wrongful Death Claim (CCP \u00a7 377.60).<\/strong> Filed by the surviving family. Compensates the family for <em>their<\/em> losses \u2014 the financial support they would have received, the household services the decedent provided, the love and companionship they will no longer have.<\/p>\n<p><strong>Survival Action (CCP \u00a7 377.30).<\/strong> Filed by the personal representative of the decedent&#x27;s estate (or, in some cases, the successor in interest). Compensates the <em>estate<\/em> for what the decedent themselves suffered between the moment of injury and the moment of death \u2014 medical bills incurred before death, lost wages between injury and death, and (under recent California law) certain pre-death pain and suffering.<\/p>\n<p>These claims are usually filed together in one lawsuit. They are not duplicative \u2014 they cover different losses \u2014 and pursuing both is often essential to fully accounting for everything the family and the estate have lost. We evaluate both at intake.<\/p>\n<h3>What Damages Are Recoverable in a California Wrongful Death Case?<\/h3>\n<p>California allows recovery of two broad categories of damages in a wrongful death case: <strong>economic<\/strong> and <strong>non-economic<\/strong>. A separate set of damages may be recoverable through the survival action.<\/p>\n<p><strong>Economic damages<\/strong> are the measurable financial losses to the family:<\/p>\n<ul>\n<li><strong>Loss of financial support<\/strong> \u2014 the income the decedent would have earned and contributed to the family over their working life<\/li>\n<li><strong>Loss of gifts or benefits<\/strong> the heirs would have expected to receive<\/li>\n<li><strong>Loss of household services<\/strong> \u2014 childcare, cooking, home maintenance, eldercare, and the many other things a family member contributes that have real economic value, even when no paycheck is attached<\/li>\n<li><strong>Funeral and burial expenses<\/strong><\/li>\n<li><strong>Medical bills<\/strong> for treatment between the time of injury and death (typically pursued through the survival action)<\/li>\n<\/ul>\n<p><strong>Non-economic damages<\/strong> are the human losses \u2014 losses that don&#x27;t show up on a pay stub but are just as real:<\/p>\n<ul>\n<li><strong>Loss of love, companionship, comfort, care, assistance, protection, affection, society, and moral support<\/strong><\/li>\n<li><strong>Loss of the enjoyment of sexual relations<\/strong> (in spousal\/domestic partner claims)<\/li>\n<li><strong>Loss of training and guidance<\/strong> (particularly significant in cases involving the death of a parent of minor children)<\/li>\n<\/ul>\n<p><strong>One important California rule:<\/strong> Grief, sorrow, and the family&#x27;s own emotional suffering are <em>not<\/em> compensable as wrongful death damages in California. This is a frequent point of confusion. What <em>is<\/em> compensable is the loss of what the decedent provided \u2014 the companionship, the guidance, the relationship. The distinction is subtle but important. A skilled wrongful death attorney knows how to develop the evidence that puts the relationship \u2014 and what was taken \u2014 in front of the jury.<\/p>\n<p>In rare cases where the at-fault conduct was particularly egregious \u2014 for example, a drunk driver with prior DUIs, or a corporate defendant that knowingly concealed a hazard \u2014 <strong>punitive damages<\/strong> may also be available, typically through the survival action rather than the wrongful death claim itself.<\/p>\n<h3>Common Causes of Wrongful Death Cases in Concord<\/h3>\n<p>Wrongful death cases in Contra Costa County most often arise from:<\/p>\n<p><strong>Fatal traffic collisions.<\/strong> I-680, Highway 4, Highway 242, Kirker Pass Road, and the Willow Pass Road carry enormous volumes of passenger and commercial traffic. A collision that would leave a driver with a sore neck can kill a rider.<\/p>\n<p><strong>Pedestrian and bicycle fatalities.<\/strong> Local safety reporting has repeatedly identified corridors like Monument Boulevard, Treat Boulevard, Port Chicago Highway, Clayton Road, and Willow Pass Road as some of Concord&#8217;s deadliest stretches for pedestrians and cyclists. Drivers running red lights, making rolling right turns, or drifting across bike lanes are recurring patterns in those fatal cases.<\/p>\n<p><strong>DUI fatalities.<\/strong> Concord&#x27;s nightlife districts \u2014 downtown Concord, the Willow Pass Road corridor, the entertainment area near Todos Santos Plaza \u2014 generate consistent late-night impaired driving.
